Zoning Board of Appeals is a quasi-judicial body that reviews and decides cases where there is an alleged error in a zoning decision or where there’s a request for a variance from the ordinance on a parcel. This includes:
Hear and decide appeals where it is alleged there is an error in any order, requirement, decision or determination made by the Zoning Administrator or any administrative official acting on behalf of the Zoning Administrator with respect to the enforcement of Chapter 135 or any ordinance adopted pursuant to said chapter.
Hear and decide special exceptions to the terms of this Chapter 135 upon which this Zoning Board of Appeals is required to determine under said chapter.
Authorize upon appeal in specific cases such variance from the terms of this chapter as will not be contrary to the public interest, where owing to special conditions, a literal enforcement of the provisions of the chapter will result in practical difficulty or unnecessary hardship so that the spirit of the chapter shall be observed, public safety and welfare secured and substantial justice done.
The Zoning Board of Appeals meets only when needed, on the 2nd Wednesday after the first Monday of the month at 5:00 PM. Zoning Board of Appeals has five members and two alternates serving a three year term.
